The current or incoming chairman of the FCC has attended every CES since at least 2009, and Pai has attended the last five shows. The Commission is in the process of editing the final repeal order, and the wording of that repeal order could possibly end up helping Pai and the FCC combat those upcoming lawsuits. During the event, Pai was supposed to be part of a so-called "candid conversation" alongside Maureen Ohlhausen, the Federal Trade Commission's acting chairwoman, to be moderated by Consumer Technology Association president and CEO Gary Shapiro. The ruling could make it hard for the FCC to repeal the net neutrality rules, and public interest groups are expected to challenge the move in court.

An FCC spokesman told Reuters that Pai would not attend the Consumer Electronics Show without giving a reason.
