San Francisco 49ers linebacker Reuben Foster arrives at Santa Clara County Superior Court. More
Foster is now awaiting a verdict for three felonies charged from the Santa Clara District Attorney's Office last month: domestic violence with an allegation that he inflicted great bodily injury, forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon. The woman flagged down a stranger's auto on Shannon Road and asked the driver to call 911, according to the Santa Clara County district attorney's office.In April, Foster's girlfriend, Elissa Ennis, issued a statement through her attorney, Stephanie Rickard, recanting the allegations and saying she made up the story about Foster punching her repeatedly in an attempt to "trash his career" after Foster tried to break off the relationship.Rickard provided the district attorney video evidence just two weeks ago that the defense says will exonerate Foster.
Ennis has said through her attorney that she initially lied about Foster hitting her on the morning of February 11 and that the injuries documented by police, including a ruptured eardrum and swollen lip, were suffered in a previous fight with a woman. Ennis told investigators at the scene that Foster struck her in the head eight to 10 times.
The District Attorney's Office said it is reviewing the video provided by Ennis and Rickard who maintain it shows that Ennis' injuries stemmed from an unrelated fight with another woman.
Even if the domestic violence charge gets dropped, there is still the possibility that Foster could face possessing an illegal firearm.
Reuben Foster pleaded not guilty to domestic violence and other charges Tuesday, setting up what could be a crucial preliminary hearing for the 49ers linebacker on May 17. She also had a ruptured eardrum. The latter is responsible for the weapons charge against Foster.
Ennis told police she had been trying to call 911 at one point, when she fell over.
Police also stated in their report that Foster's home smelled of marijuana, and that besides the rifle, they found a loaded.38 caliber revolver.

She twice returned through an unlocked back door, the police report says, and both times Foster physically threw her out, she said.
"They may seek to impeach what she says on the stand, and say the story she told initially is the stronger of the two stories", Clark said.
